We dedicate this book to John Thibaut. He was mentor and personal friend to one of us, and his work had a profound intellectual influence on both of us. We were both strongly influenced by Thibaut's insightful articulation of the importance to psychology of the concept of pro cedural justice and by his empirical work with Laurens Walker in reactions to legal institu demonstrating the role of procedural justice tions. The great importance we accord the Thibaut and Walker work is (...) evident throughout this volume. If anyone person can be said to have created an entire field of inquiry, John Thibaut created the psychological study of procedural justice. (To honor Thibaut thus in no sense reduces our recognition of the contributions of his co-worker, Laurens Walker, in the creation of the field. We are as certain that Walker would endorse our statement as we are that Thibaut, with characteristic modesty, would demur from it. ) Even to praise Thibaut in this fashion falls short of recognizing all of his contributions to procedural justice. Not only did he initiate the psy chological study of the topic, he also built much of the intellectual foun dation upon which the study of procedural justice rests. Thibaut's work with Harold Kelley (1959; Kelley & Thibaut, 1978) created a social psy chological theory of interdependence that, among many other applica tions, serves as the basis for one of the major models of the psychology of procedural justice. This book builds on the idea that pragmatics and philosophy are strictly interconnected and that advances in one area will generate consequential advantages in the other area. The first part of the book, entitled ‘Theoretical Approaches to Philosophy of Language’, contains contributions by philosophers of language on connectives, intensional contexts, demonstratives, subsententials, and implicit indirect reports. Scholars of classical philosophy have long disputed whether Aristotle was a dialectical thinker. Most agree that Aristotle contrasts dialectical reasoning with demonstrative reasoning, where the former reasons from generally accepted opinions and the latter reasons from the true and primary. How often our actions go awry because our perceptions are at odds with reality! This book examines the legal issues that arise when we seek to avoid the untoward consequences of an action by claiming that our perception was flawed. We all make mistakes. Some have unfortunate consequences: we might overpay a debt or make an unfavourable contract, or we might be sued or accused of a crime as a result of our mistake. Claims to alleviation on the grounds of (...) mistake are likely to arise wherever the law prescribes a state of mind as a prerequisite for the application of a legal rule. This book asks when the fact that a person made a mistake should entitle them to alleviation. This may involve the intention to enter into a contract or a payment, in which case a person could seek its reversal, or it might involve the intent to commit a tort or crime, in which case they could seek forgiveness for the offence. Farnsworth defines 'alleviating' mistakes as those which entitle a person to relief from untoward consequences of their mistake.There is no general 'law of mistake', and despite their similarities, few discussions of mistake in one setting pause to consider mistakes in other contexts. The goals of fields as disparate as contracts and criminal law are very different: how do these differences affect the treatment of mistakes? Farnsworth sets out a new taxonomy of mistakes. His analysis reveals that over the past century, there has been a remarkable increase in the receptivity of courts and scholars to claims for both reversal and forgiveness- a waxing of alleviating mistakes. Every student of the twentieth century has heard both of the great Viennese economist Friedrich von Hayek and of the equally great philosopher Ludwig Wittgenstein. But what isn't well known is that the two were distant cousins and that, shortly after Wittgenstein's death in 1951, Hayek set out to write a biography of his cousin. The project was derailed by Wittgenstein family members, who felt it was to soon to publish such a work - especially one like Hayek's, so candid (...) about his cousin's difficulties and depressions. But Hayek's draft acquired an underground readership, and Wittgensteins biographers have used it extensively. Here finally, is the text of that work itself - a true goldmine in being one great thinker's view of another, whom he knew personally, even if not well. Hayek's account has the great merit of being close to its subject; the draft, moreover sheds light, not only on Wittgenstein but on Hayek as well. (shrink)

We can trace the “evolutionary epic” (named by E. O. Wilson, 1978) back to earlier writers, beginning with Robert Chambers (1844). Its basic elements are: fixation on seeing human history as rooted in biology; an aspiration toward telling the whole history of humankind (in its essential features); and insistence on the overall coherence of the projected narrative. The claim to coherence depends on assuming either that the universe possesses an “embedded rationality,” or that it is guided by divine purpose. This (...) article proposes the term “idealism” to refer to these two assumptions taken together, for in practice they were closely linked. Nietzsche (1881) was perhaps the first thinker to point out the evolutionary epic's dependence on such an idealism, and he also pointed out that the assumptions of embedded rationality and of divine purpose are closely connected. Darwin's theory of descent with modification (1859) was sharply inconsistent with these assumptions: he was not an “idealist” in the sense indicated here, and not a proponent of the evolutionary epic. Proclaiming his “materialism,” Wilson (1978) failed to acknowledge that the epic depends on idealist assumptions; other adherents of the genre (M. Dowd, L. Rue) resurrect (knowingly or not) its theological roots. (shrink)

O idealismo transcendental anunciado por Husserl como idêntico à própria fenomenologia nunca deixou de ser um dos pontos mais polêmicos de sua filosofia. A esse respeito, um dos primeiros críticos da posição filosófica esposada publicamente por Husserl a partir de Ideias para uma fenomenologia pura foi seu outrora aluno Roman Ingarden. Seu denso e resoluto criticismo em relação à perspectiva idealista de Husserl é amparado por minuciosas investigações de ordem ontológica, contidas sobretudo em seu magnum opus, Controvérsia acerca da existência (...) do mundo. Contudo, algumas das discussões aí indicadas já se faziam presentes em seu famoso escrito A obra de arte literária, de 1929. Com efeito, neste texto, que busca demarcar o estatuto ontológico das obras literárias, Ingarden já empreende análises que lhe permitem questionar alguns dos pressupostos centrais ao idealismo transcendental advogado por Husserl. A proposta do presente trabalho é apresentar algumas das noções básicas da ontologia ingardeniana, bem como sua visão acerca do modo de ser da obra literária, e tentar compreender como estes elementos se coordenam a fim de fornecer a Ingarden alguns dos elementos que lhe permitem ensaiar uma resposta realista à perspectiva de Husserl. O reconhecimento da autoridade – a reputação – (...) pode ser interpretado, então, como uma espécie de poder não-jurídico, construído sobre a opinião que os indivíduos têm das ações uns dos outros. I defend the view that there is a privileged class of propositions – that there is an external world, among other such 'hinge propositions'– that possess a special epistemic status: justified belief in these propositions is not defeated unless one has sufficient reason to believe their negation. Two arguments are given for this conclusion. Finally, three proposals are offered as morals of the preceding story: first, our justification for hinge propositions must be understood as defeatable, second, antiskeptics must explain our (...) knowledge in the face of 'actual world' skepticism (like dreaming skepticism) as much as in the face of the usual sort (like brain-in-vat skepticism), and, finally, our justification for hinge propositions is basic (i.e. non-inferential). Diversos trabalhos têm apontado a existência de correlações entre o Espiritismo, tal como sistematizado por Allan Kardec, e a vertente do Socialismo utópico, ou romântico, fundada por Charles Fourier. As referências do próprio Kardec em suas publicações ao pensamento fourierista e a interação entre seguidores do Fourierismo e o nascente movimento espírita reforçam a presença de conexões que ensejam investigações mais aprofundadas. Este trabalho tem o propósito de confrontar alguns dos postulados fundamentais dessas duas doutrinas influentes e originárias do (...) século XIX, comparando suas concepções a partir de três vértices. O primeiro deles é o moral, em que se pode identificar, entre outros aspectos, a maneira pela qual as duas correntes de pensamento apreciam o problema das paixões humanas. O segundo é a perspectiva de ambas sobre a marcha evolutiva do mundo, culminando com o terceiro, que é a percepção que exibem acerca da sociedade ideal. Esse exame permite uma breve demonstração das semelhanças e diferenças que se podem encontrar nos dois sistemas de pensamento, explicitando que as características similares não implicam subordinação teórica ou equivalência entre suas propostas. Although "objectivity" is a term used widely in many areas of public discourse, from discussions concerning the media and politics to debates over political correctness and cultural literacy, the question "What is objectivity?" is often ignored, as if the answer were obvious. It is seen in the psychological makeup of individuals as well as in the lives of cultures and nations. Developmentalists from Sigmund Freud to Lawrence Kohlberg (1981), Robert Kegan (1994) and Clare Graves (1981; Beck & Cowan, 1996) have studied the growth of emotional, intellectual, and moral capabilities in individuals and extrapolated their findings to issues of cultural and international import. As their title suggests, "legal philosophers" are more philosophers than lawyers; they are in the business of thinking generally about law rather than doing law in any practical way. While lawyers tend to be jurisdiction-specific in their affiliations and competence, legal philosophers are under no such restriction. At their most ambitious, legal philosophers claim dominion over a jurisprudential realm that is delineated by neither geography nor history. Indeed, presenting themselves as intellectual citizens of the whole legal world, their crafted contributions (...) are not intended to be judged by the contingent standards of local usefulness, but by the pure canons of universal validity. As such, the professional commitment and authority of legal philosophers is based upon their capacity to deal with parochial matters of law, but in a way that rises above and is not reducible to their local circumstances. Accordingly, while these legal philosophers might talk about morality and politics as they relate to law, they do so only in the most theoretical and abstract terms. For them, philosophy inhabits the realm of "truth and necessity" in which the contingent and the local holds little or no analytical sway. The contemporary champion of legal philosophy is undoubtedly Joseph Raz. His extensive and sophisticated work represents the high-water mark of analytical jurisprudence. With the recent publication of Between Authority and Interpretation, he has provided an accessible and stylish showcase of his philosophical theory of law that is as rigorous and demanding as it is provocative and controversial. Because this book builds on as it clarifies and develops the main themes of his work over the past four decades, it offers itself as a convenient focus for a more general assessment of Raz's whole oeuvre. In traversing law's terrain, he is adamant that, whatever the purposes and methods of other disciplines (e.g., sociology, history, anthropology, etc.), any philosophical analysis worth its name must concern itself with delivering insights and understanding about law that are of universal significance. While general conclusions about local laws and systems are important and helpful, they will have no philosophical value unless they can say something general and enduring about law as an institutional phenomenon. A corollary of this is that legal philosophy must insulate itself from contingent moral and political influences that will compromise or contaminate its project of making statements about law?s nature and operation that are not only universally valid, but also locally accurate. In this essay I challenge Raz's philosophical ambitions - and, therefore, much contemporary work in legal philosophy - by concentrating on his crucial methodological distinction between the local and contingent and the universal and necessary. It is my contention that, as there are no places where "moral and political desirability" do not play a role, "necessity" has no reign. Accordingly, I argue that legal philosophy cannot live up to its own methodological expectations and standards of validation. For all its impressive erudition and sophistication, therefore, Raz?s work is a manifesto of "local enthusiasms" that, while instructive and useful in themselves, can lay no claim to reveal the necessary features of law's existence. His work comprises some very contingent and localised generalisations that no amount of philosophical razzle-dazzle can elevate to universal and global truths about law. Blinded by the philosophical light, there is more formal brilliance than substantive bottom-line to Raz's jurisprudence. (shrink)

O presente artigo discute a importância das aulas de regência do estágio supervisionado, cuja finalidade é desenvolver em cada estudante em formação, a compreensão da relação teórico-prática durante o tempo universidade e promover o contato inicial com a docência. O estágio supervisionado, como componente curricular obrigatório no curso de Licenciatura Intercultural Indígena em Matemática, estabelece esse diálogo entre a teoria apreendida no contexto da educação escolar indígena (tempo-universidade) e sua aplicabilidade na prática comunitária das escolas estaduais indígenas de Alagoas. Este (...) trabalho trata das observações realizadas no transcorrer do Estágio Supervisionado II com alunos do Alto Sertão de Alagoas. As informações apresentadas resultam das observações e participações nos cenários escolares por parte do autor e co-autora e, nas salas de aula, pelo autor na condição de professor orientador que acompanhou o desenvolvimento das aulas de regências. A investigação foi amparada por uma revisão bibliográfica e por relatos obtidos nas observações das aulas de regência. Teve como aporte teórico Bianchi et al. (2005), Lima e Pimenta (2006), Pimenta (1997), Tardif (2002) e dentre outros. O estágio mostrou-se como um espaço de importantes reflexões e debate, ações e atitudes e crescimentos e experiências no contato com a profissão escolhida. (shrink)

The following article shows what Tacitus Ann. 15,44 thought of the role of the Chrestiani at the burning of the Roman capital A.D. 64 and why they themselves as punishment of their,,crime“ were crucified and burned. In order to demonstrate this the textus receptus is first analysed linguistically and its content interpreted in its historical and sociological context. It is ethnohistorically established as a fact that Tacitus counted the Chrestiani as a minority of the Iudaei. Linguistically it is proved that (...) the words aut flammandi atque ubi are corrupt and have to be emended ad flammas dati, ut, cum why some of the Chrestiani as part of their punishment were given to the flames, i.e. Latine: ad flammas dati. Walter Benjamin e um setor da Teologia da Libertação, em especial aquele que se articula em torno à Escola do DEI, tem diversas convergências na crítica do capitalismo como religião. Esta proposição desafia pressupostos modernos das teorias da religião exigindo uma revisão conceitual que permita compreender melhor o poder de legitimação/fascínio ou questionamento da economia política capitalista. Neste artigo procuramos refletir sobre esta revisão da teoria da religião e propor uma abordagem que relaciona Benjamin e a teologia da libertação. Para (...) isso, propomos exemplificar os desafios teórico-práticos desta relação e percorrer alguns estudos que re-situam os conflitos epistemológicos e políticos da religião com a modernidade. Em seguida, buscamos elementos de Benjamin e da Escola do DEI que fornecem instrumental analítico potente para a crítica do fetichismo capitalista como religião cotidiana. Por fim, sintetizamos a tarefa fundante de pensar, a partir da vida das vítimas, um necessário discernimento de deuses que permitem des-ocultar a razão mítico-teológica que caracteriza o espírito do fetiche.
